Nothing in these Terms is to be interpreted as excluding, restricting or modifying or having the effect of excluding, restricting or modifying the application of any State or Federal legislation applicable to the sale of goods and services which cannot be excluded, restricted or modified (including, but not limited to, the provisions of the ACL).

13.CLAIM PROCEDURE

  1. If the Customer wishes to make a claim pursuant to these Terms, it must send the relevant Goods (including all relevant parts provided with the Goods at the time of sale) to PPG (at the address specified at clause 15 below) at its own cost and at its own risk, accompanied by a copy of its receipt for the Goods clearly showing the date and full details of the purchase, within 14 days of the defect becoming reasonably apparent.

    3. appropriate documentation such as historical or repair records; and

    4. any further information reasonably requested by us.

  3. The Customer warrants that all information provided with a warranty claim is true, correct and complete.

  4. Once the Goods have been delivered, we will assess the Goods and determine:

    1. The cause of the failure; and

    2. What will be required to remedy the failure.

  5. If the result of the assessment is that the failure of the Goods is covered by these Terms, we will in our absolute discretion select and provide one of the remedies set out in clause 9 and you will be entitled to claim your reasonable expenses incurred in relation to the defect, by contacting us at the contact details specified in clause 15 below.

  6. If the report establishes that the failure of the Goods is not covered by these Terms or the ACL, we will notify you and you will need to pay the costs of the return of the Goods, and any related costs (such as the cost of an independent maintenance specialist – if relevant).

  7. The timing of any repair is not fixed and may depend on the repair schedule, staffing and availability of parts.

  8. Any Goods replaced or repaired by us under these Terms will be warranted for the remainder of the original warranty period for the replaced or repaired Goods.

  9. To the extent permitted by law, in the case of Goods not manufactured by PPG, the sole liability shall be passed to the Customer together with the benefit of any guarantees, conditions or warranties received by PPG in respect of such Goods.

14.REMEDY

  1. For all Goods covered by the warranty under these Terms, PPG will either (at PPG’s complete discretion):

    1. repair or replace the Goods free of charge; or

    2. cause the defective Goods or the defective part of the Goods to be repaired or replaced by a qualified repairer free of charge.

    3. These remedies are the Customer’s sole and exclusive remedy for defective Goods, subject to the provisions of the ACL (if applicable). If the Customer is a “Consumer” (as defined in the ACL), nothing in this clause 14 limits any remedy available for a failure of any of the consumer guarantees under the ACL.

  2. PPG reserve the right to replace defective parts of the Goods with parts and components of similar age, quality, grade and composition where an identical part is not available. Goods presented for repair may be replaced by refurbished goods rather than being repaired. Refurbished parts may be used to repair the Goods.

15.RESPONSIBILITY OF THIRD-PARTY DAMAGES AND RIGHTS

  1. PPG will not be responsible for damages, costs and expenses that are the result of work carried out in accordance with Customer requests, designs or specifications. This includes the infringement – or alleged infringement - of third party intellectual property rights, registered designs or patents.

16.SUB-CONTRACTING OF WORK

  1. PPG reserves the right to sub-contract work – either in whole or part - at its absolute discretion.

17.CONFIDENTIALITY

  1. Any information, technical or otherwise, provided by PPG to the Customer remains the property of PPG and is to be regarded as confidential and may not be disclosed unless written permission has been granted by PPG. Permission to disclose does not transfer the ownership or rights of the property.

18.RETURN OF GOODS

  1. In cases where PPG has agreed that Goods may be accepted for credit, they must be returned in good order and a re-saleable condition within six-months of being supplied. Carriage will not be paid by PPG unless previously agreed in writing with the Customer. A handling charge of 15% of the Price may be applied.

  2. Goods made to special order cannot be returned and therefore, no credit will be issued unless it is proved conclusively that they are incorrectly made or defective as a result of work carried out by PPG.

19.LAW

  1. The law of South Australia from time to time govern these Terms. The parties agree to the non-exclusive jurisdiction of the courts of South Australia and of the courts entitled to hear appeals from those Courts.

  2. PPG's failure to enforce any of these Terms shall not be construed as a waiver of any of PPG’s rights.

  3. If any clause of these Terms is unenforceable it shall be read down to be enforceable or, if it cannot be read down, the term shall be severed from these Terms, without affecting the enforceability of the remaining terms.

  4. A notice must be in writing and handed personally or sent by email, facsimile or prepaid mail to the last known address of the addressee. Notices sent by pre-paid post are deemed to be received upon posting. Notices sent by facsimile or email are deemed received on confirmation of successful transmission.
